Dear Chair Cruz and Ranking Member Cantwell,
On behalf of the organizations dedicated to improving the mental health and wellbeing of our nation’s children and youth, we respectfully request that this Committee meet the demands of the moment and schedule a markup of the Kids Online Safety Act (KOSA) (S. 1748) without delay and without amendments that would dilute the legislation.
With bipartisan support, the U.S. House of Representatives passed its own package of children’s online safety legislation, the Kids Internet and Digital Safety (KIDS) Act (H.R. 7757) in a vote of 267-117. For the first time since the U.S. Senate passed KOSA by a vote of 91 to 3 in the 118th Congress, there is the prospect of bipartisan legislation moving in both chambers at the same time. Both bills have merit and contain provisions that must be strengthened to truly hold the companies behind online platforms accountable for the harm they have inflicted on America’s children. That is precisely why the Senate must move now.
This spring, the Chair stood before grieving parents and allied organizations and committed to advancing this legislation out of committee and signing it into law by the end of the year. Every week KOSA is stalled represents another week online harms continue unchecked. However, the moment KOSA advances through committee, the House and Senate can finally begin the difficult work of reconciling and strengthening their versions into the strongest child online safety legislation that can be passed into law.
We respectfully and urgently ask this Committee to bring the Kids Online Safety Act to markup now and give the families of this country the vote they have waited far too long to see. We stand ready to assist the Committee and its staff in any way that moves this bill forward.
